Bids will be received at the Office of Economic and Community Development until 3:00 pm (local time) on Thursday, June 13, 2019. All contractors are encouraged to visit the project sites and to contact the Owner for access to each building if desired. Bids will be opened in public on June 13, 2019 at 3:00 pm, and bidders can attend the opening. The envelopes containing the Bids must be sealed, addressed to the:

The following properties will be individually bid out:

1. 12-14 Union Street
2. 4- Franklin Street
3. 1-7 North Street
4. 2 West Main Street
5. 5 East Main Street
6. 8-10 East Main Street

Contractors have the option to bid on all or some of the properties listed above. Bids will be awarded individually by property owner.

The Information for Bidders, Drawings, Specifications and other Contract Documents may be reviewed at the Office of Economic and Community Development, becoming available approximately three weeks prior to the bid due date. Addenda, if any, will be issued to only those persons whose name and address are on record of having obtained the Contract Documents.

The Middletown Office of Economic and Community Development is not the OWNER. Individual property Owners are listed on the separate bid forms.

STATEMENT OF NON-COLLUSION: Bidders on Contracts are required to execute a non-collusive bidding affidavit pursuant to Section 103d of the General Municipal Law of the State of New York.

No bidder may withdraw his bid within forty-five (45) days after the actual date of the opening thereof. All bid prices to be valid for forty-five (45) days after bidding due date.

Subject to the provisions of Article 28, Part III of the New York State Tax Law and the provisions of the Contract Documents, the Owner is exempt from payment of sales and compensating use taxes of the State of New York and cities and counties on all materials supplied to the Owner pursuant to this contract.

The Office of Economic and Community Development hereby notifies all bidders that it will affirmatively insure that regarding any contract entered pursuant to this advertisement, minority business enterprises will be afforded full opportunity to submit bids in response to this invitation and will not be discriminated against on the ground of race, color or national origin in consideration of an award.

The State has established a goal to include at least 22% MBE participation and 10%WBE participation. The lowest bidder must submit, either with their bid or within seven business days of notification of selection, a Grants MWBE Utilization Plan, Contractor's Solicitation Log and documentation that NYS Certified Minority and Women-Owned Business Enterprises (MWBEs) were contacted during preparation of said bid. Participants that do not submit the Grants MWBE Utilization Plan, Contractor's Solicitation Log and evidence of their good faith efforts will be deemed non-responsive and their bid may be rejected. Evidence of good faith efforts is contact by certified mail, follow-up with phone contact and a summary of all contact and results. Prior to the award of a contract to the lowest bidder, review and acceptance of the bid summary and all MWBE documentation by State Parks is required.
