Sealed Bids for construction of the Finished Water Pump Station will be received by the City of Middletown at the office of the City Clerk, City Hall, 16 James Street, Middletown, New York 10940. Bids will be received until 4:30 PM on Thursday, December 12, 2019, at which time they will be publicly opened and read.

The project involves construction of a new Finished Water Pump Station at the Middletown Water Treatment Plant, including three new vertical turbine finished water pumps within a new pre-engineered metal building and associated piping, valves, HVAC, electrical, and controls.

Each Bid shall be submitted in accordance with the Instructions to Bidders and shall be accompanied by a Bid Security in the amount of five (5) percent of the Bid.

Bidders may not withdraw their Bids for a period of forty five (45) calendar days after the actual date of the opening of the Bids.

The Successful Bidder must furnish a 100 percent Performance Bond and a 100 percent Payment Bond with a surety company acceptable to the Owner.

Wage rates for this Project are subject to the minimum wage rates as per the New York State Department of Labor. In addition, the successful bidder will be required to comply with Section 816-b of the New York State Labor Law regarding apprenticeship program.

The Owner reserves the right to waive any informality in or to reject any or all Bids if deemed to be in its best interest.

Sealed Bids for the construction of the East Main Street Site Improvements will be received by The City of Middletown Board of Estimate and Apportionment, at the office of the Department of Public Works (16 James Street, Middletown, NY 10940), until 4:30 p.m. local time on November 14, 2019, at which time the Bids received will be publicly opened and read. The Project consists of constructing concrete sidewalk, concrete curbing, asphalt paving, storm sewer, fencing, guiderail, and plantings.
Bids will be received for a single prime Contract. Bids shall be on a lump sum and unit price basis, with additive alternate bid items as indicated in the Bid Form.
The Issuing Office for the Bidding Documents is: P&P Quick Copy Center, 520 Temple Hill Road, New Windsor, NY, 12553 (845) 565-4260. Prospective Bidders may examine the Bidding Documents at the Issuing Office on Mondays through Fridays between the hours of 9:00 a.m. and 4:00 p.m., and may obtain copies of the Bidding Documents from the Issuing Office as described below.

Bidding Documents may be viewed and ordered at the Issuing Office. The cost of printed Bidding Documents from the Issuing Office will depend on the number and size of the Drawings and Project Manual, applicable taxes, and shipping method selected by the prospective Bidder. Cost of Bidding Documents and shipping is non-refundable. Upon Issuing Office’s receipt of payment, printed Bidding Documents will be sent via the prospective Bidder’s delivery method of choice; the shipping charge will depend on the shipping method chosen. The date that the Bidding Documents are transmitted by the Issuing Office will be considered the Bidder’s date of receipt of the Bidding Documents. Partial sets of the Bidding Documents will not be available from the Issuing Office.
A pre-bid conference will be held at 10:00 a.m. local time on Thursday, October 30, 2019 at the City of Middletown Department of Public Works office, City Hall, 16 James Street, Middletown, NY 10940. An onsite “walk-through will immediately follow. Attendance at the pre-bid conference is highly encouraged but is not mandatory.

Bid security shall be furnished in accordance with the Instructions to Bidders.
Bidders on this work will be required to comply with the President's Executive Order Nos. 11,246 and 11,375, which prohibit discrimination in employment regarding race, creed, color, sex, or national origin. Statement of Non-Collusion: Bidders on the contract are required to execute a non-collusive bidding certificate pursuant to Section 103d of the General Municipal Law of the State of New York.
Security for Faithful Performance: The successful bidder will be required to furnish Performance and Labor and Material Payment Bonds written by firms licensed to do business in New York State, each in the amount of one hundred percent (100%) of the contract amounts in accordance with the provisions of the Contract Documents.
Sales and Use of Tax Exemptions: The City of Middletown is exempt from the payment of sales and compensation use taxes of the State of New York and of cities and counties on all materials, equipment, and supplies sold to the City of Middletown pursuant to this contract. Also exempt from such taxes are purchases by the Contractor and his Subcontractors of materials, equipment, and supplies to be sold to the City of Middletown pursuant to this contract, including tangible personal property to be incorporated in any structure, building or other real property forming part of the project. These taxes are not to be included in the Bid.
Attention of bidders is particularly called to the requirement as to conditions of employment to be observed and minimum wage rates paid under the contract, Section 3, Segregated Facilities, Section 109, and Executive Order 11246. The requirements for Bidders and Contractors under this order, which concerns non-discrimination in employment, are explained in the Contract Documents. Bidders are also required to comply with the provisions of Section 291-299 of the Executive Law of the State of New York.
All bids shall be binding for a period of forty-five (45) days after the bid opening date. The City of Middletown reserves the right to reject any and all bids and to waive any informalities therein.
